RESOLUTION OF THE
BOARD OF DIRECTORS OF
RIVERPARK ESTATES HOMEOWNERS ASSOCIATION
 
The undersigned, on behalf of the Board of Directors of the Riverpark Estates Homeowner’s Association (the “REHOA”), acting by meeting and vote, hereby waive all notices, statutory or otherwise, and consent to and approve the following resolution.
 
WHEREAS, the REHOA Board of Directors approved certain Riverpark Estates Homeowner’s Association Rules and Regulations In Compliance with the Declaration of Protective Covenants (“Rules and Regulations”) originally adopted on September 20, 2007, re-adopted on September 18, 2008, and attached hereto as Exhibit A; and
 
RESOLVED, that the REHOA officers confirm the Rules and Regulations attached hereto as Exhibit A are hereby ratified, approved, and confirmed in all respects. 
 
RESOLVED, that the Rules and Regulations are effective immediately following mailing of the same to each homeowner and resident.

Rules and Regulations
In Compliance with the Declaration of Protective Covenants (CC&R’s)
  1. All pets must be kept on leashes in the community, and owners are expected to clean up any waste they leave.  Please respect the private property of others.
  2. Noise free time within the community shall be between 10:00 p.m. and 7:00 a.m. This means that all outside noise such as loud music, sports games, loud visiting, and the like, must cease by 10:00 p.m.  This is consistent with City of Auburn noise ordinances.
  3. There is no excess noise allowed at anytime. This includes booming outside stereo systems, loud bass car amplifiers, or music with vulgar or obscene lyrics.
  4. Only Legal Fireworks (Safe and Sane) are allowed on the 4th of July within the neighborhood and must comply with the City of Auburn fireworks rules and regulations, which means that “anything that goes up or blows up” is considered illegal.
  5. Lawns and landscaping are to be maintained in the manner set forth by the Declaration of Protective Covenants. This includes lawns that are edged and maintained on a regular basis, weeding of all flower beds, trimming and general maintenance of shrubs and trees.
  6. Home improvements including, but not limited to, exterior painting, fencing, adding free standing buildings and any new construction, must not be initiated until a properly executed Architectural application (ACC Form) for such improvements is submitted and approved by the REHOA Architectural Control Review Committee.
  7. RV’s, boats, trailers, and water craft of any kind are only allowed on the street or in a homeowner’s driveway for no more then a 24 hour period, at which time they must be moved unless they are stored and covered under carport areas.
  8. Fences visible from the street must be power washed and stained/painted as needed.  Painting of fences requires an Architectural application to be submitted along with proposed color samples prior to beginning work.
  9. Portable basketball goals are not allowed to block any sidewalk or be placed in the residential streets.
  10. Automobiles parked illegally on the streets of the community will be tagged and towed at the owner’s expense.
  11. Vehicles stored in driveways that appear to be in a state of disrepair and/or in an unsightly condition shall not be allowed.
  12. Carport areas are to be kept clear of debris and not to be used for storage; however, areas may be used as a patio that is kept in an orderly and sightly manner.
Note:  Violations of these rules and regulations will be subject to application of the Board-approved REHOA fining policy, which may result in a $150.00 fine to the homeowner for each incident or occurrence.  These rules and regulations will also be given to our Auburn Police patrol officers and towing service contractor that work within the Association Area.
